Welcome to SuperFreight! By accessing our website at https://superfreight.com.au and using our SuperFreight platform and/or services (collectively, “SuperFreight Services”), you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1       Acceptance of Terms

By using the SuperFreight Services, you agree to these Terms and Conditions. Users who create SuperFreight accounts or using the SuperFreight Services will be deemed to have accepted and agreed to the Freight Service Agreement[KWM1]  with EIZ Pty Ltd. If you do not agree with any part of these terms, you must not use the SuperFreight Services.

2       Services Offered

The SuperFreight Services provide an all-in-one freight solution for global eCommerce. Our platform integrates with other EIZ systems that are also subject to these Terms and Conditions.

3       Use of Services

The SuperFreight Services are available only to individuals who can form legally binding contracts under applicable law. By accessing and using the SuperFreight Services, you represent that you are of sufficient legal age to access, and use these services and to create binding legal obligations for any liability you may incur as a result thereof. You also warrant that you are legally authorized to place shipping orders for either yourself or another entity for whom you are authorized to act.

4       User Accounts

To access and use the SuperFreight Services, you will be required to create a SuperFreight account or have an existing account associated with an EIZ product. You agree to provide accurate, current, and complete information during the account registration process and to update such information to keep it accurate, current, and complete.

5       Payment Terms

a)    Credit Card payment: Users may authorize SuperFreight to charge their credit cards on their behalf, along with a transaction summary.

b)    Top-up payment: Users may add funds to their SuperFreight accounts and agree to authorize SuperFreight to charge their top-up account balance for shipping services on a pay-as-you-go basis.

For this payment, an estimated price will be provided for reference. This estimated price is typically calculated based on the declarations you made, such as the weight and dimensions of the goods you intend to ship, as well as the reference pricing shown on our website or platform. Such price must be referred to as an estimate only.

Final price, however, may vary due to a range of factors, including but not limited to the reweighing and remeasurement of goods. If the declaration is incorrect or the reference pricing on our website/platform is updated, any additional fees will be charged to your top-up accounts. We reserve the right to debit your top-up accounts for these additional charges by providing a transaction summary outline detailing any such additional charges.

Users who are found to be regularly under-declaring may result in the suspended or terminated use of their SuperFreight Accounts/Services.

c)     Invoiced payments: For the remaining users, services are provided on an invoiced basis. Credit limits will be applicable by submitting Business Credit Application[KWM2]  to us. Users must ensure timely payment of all invoices.

All payment transactions will be processed securely. Users may dispute any charges by emailing [Insert Email Address] within 7 days of receipt of an invoice or transaction summary.

6       User Responsibilities

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

7       Privacy and Data Processing

By using the SuperFreight Services, you agree to our collection, use, and storage of your personal information necessary for us to provide the shipping services within the SuperFreight platform. SuperFreight adheres to the Australian Privacy Principles (APPs) as outlined in the Privacy Act 1988. Your personal data will be handled responsibly, with strict measures to prevent unauthorized access or disclosure.

8       Intellectual Property

All content displayed or derived from the SuperFreight Services, including but not limited to text, graphics, logos, and software, is the property of SuperFreight or its licensors and is protected by copyright and intellectual property laws.

9       Acceptable Use Policy

You agree not to use the SuperFreight Services in ways that violate Australian law, including but not limited to: a) uploading malicious content (viruses, malware); b) using the platform to defraud others; c) engaging in illegal or unauthorized transactions. Violation of this policy may result in the termination of your account and/or SuperFreight Services.

10    Limitation of Liability

To the fullest extent permitted by law, SuperFreight shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the SuperFreight Services. However, nothing in these terms shall exclude or limit SuperFreight’s liability for any guarantee that is implied by law, including those set out in the Australian Consumer Law (ACL).

11    Modifications

We reserve the right to modify these Terms and Conditions at any time. We will notify users of any significant changes via the platform or by email. Your continued use of the SuperFreight Services after such modifications constitutes your acceptance of the new terms and conditions.

12    Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia. If you have any disputes with SuperFreight, you agree to first contact us directly to seek a resolution by emailing [Insert Email Address]. If the dispute is not resolved through negotiation, either party may submit the matter to the courts of Victoria, Australia.
